Alternative Payment Method Terms

By using the Alternative Payment Methods as described herein below (the “Alternative Payment Methods”), you agree to be bound by SumUp’s Terms as entered into for the use of our Services (“Terms”), these Additional Terms of Alternative Payment Methods (“Alternative Payment Method Terms”), and all other terms and policies applicable to your use of SumUp products and services, as well as the user documentation that SumUp may make generally available in hardcopy or electronic form to its general customer base in conjunction with the offering of the Alternative Payment Methods ("Documentation")

You may decide whether you wish to use an Alternative Payment Method or not. If you are using Alternative Payment Methods for your business, you agree that you are accepting these Alternative Payment Method Terms. Unless otherwise defined herein, capitalized terms shall have the same meaning as in the Terms.

Alternative Payment Methods 

An Alternative Payment Method is any payment method listed in the table below (Schedule 1), that may enable your customers to pay for your products and services to your Account. The Alternative Payment Methods are made available through an Alternative Payment Method functionality offered by SumUp (the “Functionality”) that can be integrated to our card-not-present payment services and allows your customers to select and use an Alternative Payment Method to make their payments to you. 

The availability of the Alternative Payment Methods is subject to geographical restrictions. Depending on your location, you may not be able to use one or more of the Alternative Payment Methods listed in the table below. You may see which Alternative Payment Method are available to your country in the Support Centre article.

Payments accepted through the Alternative Payment Methods are subject to our standard fees for card-non present transactions, as available on our website and/or as communicated to you.

The Alternative Payment Methods are sourced from third party providers that help us to enable you to use the Functionality (“Providers”).

Schedule 1 contains the different Alternative Payment Methods that you may use and offer to your customers from time to time, subject to availability. It further contains additional standards, rules, procedures and requirements in relation to certain Alternative Payment Methods as may be imposed by the Providers (the “Specific Terms”). You hereby agree to comply with the Specific Terms at all times. 

Your obligations

You hereby undertake to:

  1. comply with all applicable law relating to online or distance sales agreements including consumer protection laws;

  2. not request a surcharge from customers for a specific or all Alternative Payment Methods, unless such surcharge is explicitly allowed by the Alternative Payment Method (as stated in Specific Terms in Schedule 1) and applicable law;

  3. have reasonable customer support service in place.

In order to be able to use the Functionality and offer the Alternative Payment Methods, you may be required to complete and submit a completed registration form. 

You shall reasonably cooperate with requests by us or our Providers for information in specific situations that require further investigation in relation to an Alternative Payment Method.

You shall not use SumUp to proactively refund payments processed through the Alternative Payments Methods unless the Specific Terms in Schedule 1 explicitly allow this. 

As some Alternative Payment Methods may require the re-direction of the customer to an online banking page (“Redirect Payment Methods”), in such case you must ensure that the customer is able to recognize that the re-direction has occurred via the display of the bank’s URL in the address line of the browser, and visibility of the relevant security certificate. In addition, you may not use any i-frames when including the Redirect Payment Method in your payment process. Redirect Payment Methods must not be used for the purposes of verifying the identity or age of customers without obtaining our express written permission beforehand. 

Payments made through Alternative Payment Methods may be reversed by the Providers unless otherwise stated in the Specific Terms in Schedule 1. Your obligations and liability towards SumUp for any reversed payments are the same as those you have towards us for Chargebacks under the Terms. The Providers may influence the reversal of a payment made through Alternative Payment Methods in the same way as the relevant Card Scheme, our processor, or any of our designated financial institutions may influence a Chargeback. 

Restrictions

The Alternative Payment Methods can only be used for payment for your products and services where there is a direct contractual relationship between you and the customer, and the products and services are provided on your own account. SumUp will not be liable or responsible for any product or service-related claims made against you by your customers.

Further to the restrictions imposed by the Terms, you acknowledge and agree that the Alternative Payment Methods are not permitted to be offered, used or otherwise made available for any of the following categories of business: A. any goods and services which are illegal as such or for which the promotion, offer or distribution of are illegal or which are offered in connection with illegal, obscene or pornographic content; B. any goods and services whose promotion, offer or distribution would in- fringe copyrights and intellectual property rights as well as other rights of third parties; C. any goods and services which are connected to war or terrorism or the glorification thereof; D. any material to incite sexual or physical violence against any person; E. any material that can be reasonably classified as promoting hate speech or promoting violence against a group of persons based on their race, gender, religion, physical or mental capabilities, or sexuality; F. archaeological finds; G. drugs, narcotics and psychotropic substances; H. goods that are subject to a trade embargo; I. media harmful to young people, as far as the particular offer violates applicable law and in particular, legal provisions for the protection of minors; J. body parts and mortal remains of humans; K. Nazi articles and publications; L. protected animal and plant species; M. Lotteries promoted over the phone.

SumUp may at its sole discretion decide whether your use of the Alternative Payment Methods shall be deemed attributable to any of the above products or services and therefore not in accordance with the Terms or these Alternative Payment Method Terms. We retain the right to suspend or terminate your Account your access to the Functionality in case you have violated any of the restrictions above. SumUp reserves the right in their sole discretion, to add categories of prohibited transactions or business categories by adding such categories either to the Terms or these Alternative Payment Method Terms.   

Changes

We may add or remove Alternative Payment Methods from the list in Schedule 1 at any time. If we remove an Alternative Payment Method, we will inform you beforehand, unless we are required by our Providers to cease offering the Alternative Payment Method. The Specific Terms in Schedule 1 as provided by Providers, may be subject to change at any time, and you shall periodically review them in order to ensure that you are aware of, and comply with, the applicable requirements.

All other changes shall be made as pet the Amendments process under the Terms. 

Cancellation or Termination 

You may cancel your use of the Alternative Payment Methods at any time through your Account, and the Functionality would be removed. This shall not affect the existence of your Account and the effect of the Terms. 

We may suspend or terminate your use of the Alternative Payment Methods for any or no reason at any time upon prior notice to you (where possible), without liability to you. 

These Alternative Payment Method Terms survive any cancellation or termination to the extent and for so long as we require to: (i) deal with matters arising from your use of the Alternative Payment Methods; and/or (ii) comply with applicable law. 

After termination of these Alternative Payment Method Terms, you will continue to be liable towards us for Chargebacks and all your outstanding obligations arising from your use of the Functionality prior to termination. 

Schedule 1 – List of Alternative Payment Methods and Specific Terms 

Sofort

Payment type: Real-time Bank Transfer. SOFORT is a bank transfer Alternative Payment Method. Recipients can receive a real-time confirmation of the transaction.

Refund possibility: Yes

Transaction minimum: €1.00 per transaction

Transaction maximum: €5,000.00 per transaction

Specific Prohibited Goods and Services: None other than those prohibited goods and services set out within the Terms and the Alternative Payment Method Terms.

Supplemental Terms: N/A

iDEAL

Payment type: Real-time Bank Transfer. iDEAL is a bank transfer payment method. Recipients can receive a real time confirmation of the transaction. iDEAL is restricted to use by customers who have been issued an online bank account that is iDEAL compatible and held at a bank based in the Netherlands.

Refund possibility: Yes

Transaction minimum: €1.00 per transaction

Transaction maximum: N/A

Specific Prohibited Goods and Services: None other than those prohibited goods and services set out within the Terms and the Alternative Payment Method Terms.

Supplemental Terms:

  1. You will provide an effective complaints procedure that is easily available to your customers, in which you can be contacted by e-mail as well as another means of direct contact (such as telephone or chat).

  2. You are not permitted to offer the iDEAL Alternative Payment Method via e-mail link services unless you obtain the prior written permission of SumUp. An iDEAL payment link is a URL that leads to your payment page on which a customer can initiate an iDEAL transaction.

  3. You must cooperate with requests for information in specific situations that require further investigation in relation to your use of iDEAL.

  4. You are responsible for verifying that the status of an iDEAL Transaction is “successful” before you supply your product or service.

  5. In the event of your breach of these supplemental terms, the Terms or the Alternative Payment Method Terms, or if there is actual or suspected fraud on your account, we may immediately terminate the Alternative Payment Method Terms and/or your use of iDEAL.

  6. You will adhere to the terms and conditions for the use of iDEAL under the iDEAL Merchant Integration Guide (MIG), including the use of the iDEAL logo, available on Ideal website.

  7. You may not remove any issuers from the issuer list.

  8. Where at SumUp’s sole discretion you are deemed to be high risk, SumUp reserves the right to request you to implement a customer registration process to record at least the following data concerning the customer: a) Name and e-mail address; b) Account number and name for the bank account number which is being used to make purchases via the iDEAL Alternative Payment Method; c) Additional information for verification in step 2 and the monitoring of Transactions, for example: i. IP address ii. Browser fingerprint iii. Mobile number

Bancontact

Payment type: Debit Card. Bancontact is a debit card Alternative Payment Method, whereby a debit card is issued by an authorised credit institution and allows customers to directly pay for goods and services from their bank accounts.

Transaction minimum: €1.00 per transaction

Transaction maximum: N/A

Specific Prohibited Goods and Services: None other than those prohibited goods and services set out within the Terms and the Alternative Payment Method Terms.

Payment Type : Cash Payment  

Chargeback Risk: No   

Refund possibility: N/A  

Transaction minimum: 1 USD per transaction 

Transaction maximum : 3,000 USD per transaction 

Specific Prohibited Goods and Services: In addition to those prohibited goods and service listed in the Terms and the Alternative Payment Method Terms:. Bootleg recordings; counterfeit items; embargoed goods; illegal drugs and paraphernalia; offensive, racially or culturally insensitive material; adult content, materials, and/or services, including, but not limited to adult books and videos, adult telephone conversations, adult websites, companion/ escort services, dating services (sexually oriented), mail order brides, miscellaneous adult entertainment; cash; damages, losses, penalties, or fines of any kind; costs or fees over the normal price of Merchants’ goods or services (applicable taxes) or charges that Customers have not specifically approved; overdue amounts, or amounts covering returned or stop-payment checks; sales made by third parties; amounts that do not represent bona fide sales of goods and services by Merchant’s business (e.g., purchases by Merchant’s owners (or their family members) or employees); illegal business Transaction; money laundering or the financing of terrorist activities. 

Supplemental Terms: Boleto Bancario is a Payment Method restricted to Customers in Brazil offering two alternatives of payments for Customers: One is a bank transfer via Customer ́s online banking, the other alternative is cash payment at bank branches and other authorized payment points such as supermarkets, pharmacies and post offices. SumUp has no control over such payment points and accordingly does not guarantee the availability of Boleto Bancario throughout Brazil or other markets it may operate.
