SumUp Connect Terms and Condition

1. Customer relationship
1.1 The provider of SumUp Loyalty Connect loyalty program (“Loyalty Program” or “Rewards Program”) is SumUp Payments Limited (“SumUp”, “we”, “us”). SumUp merchants participating in SumUp Connect (“Merchant(s)”) can offer rewards for the purchase of goods and/or services in the UK to their customers (“you” or “yours”).
1.2 The Loyalty Program allows you to collect Loyalty Points (“Loyalty Points”) on purchases on the Merchant’s goods or services and to redeem them with the Merchant for various rewards (“Rewards”), as dictated by the Merchant’s rewards offerings.
1.3 By joining the Loyalty Program, you confirm that you are at least 18 years old and a resident of the UK. These Conditions of participation govern the relationship between you and Us.
1.4 We reserve the right to terminate and/or to discontinue the Loyalty Program, or to change the terms, regulations or benefits of participation of such Loyalty Program, in whole or in part, at any time with or without notice. Furthermore, we reserve the right to cancel any or all collected Loyalty Points. Upon expiration of the Loyalty Program, you no longer have the right to collect or redeem the Loyalty Points. Collected Loyalty Points will also not be paid out, and at no time have any monetary value.
2. Requirements for participating in the Loyalty Program and for collecting Rewards
2.1 In order to participate in the Loyalty Program and to earn Rewards you must first provide us with your phone number and/or email address. Please note that you may not have an account that is accessible by you except if you visit the Merchant's store, where you can view, accumulate, and redeem your accumulated Loyalty Points.
2.2 Not every purchase at the Merchant’s location entitles you to earn Loyalty Points. If a purchase is eligible for Loyalty Points, the Merchant will inform you and disclose the number and details associated with that purchase by telling you verbally or via information screen in the Merchant’s location. The Merchant reserves the right not to fulfil your request in case of increased traffic in the store.
2.3 You can find the current value of Loyalty Points and Rewards for your purchase, which can change from time to time, in the Merchant's location. We reserve the right and at our sole discretion to suspend the opportunity of collecting Loyalty Points and to change the value of Rewards and/or Loyalty Points collectable at any time.
2.4 To earn Loyalty Points, the purchase including the transaction must be fully completed. Purchases that are not complete will not earn points, and we bear no responsibility for the failure of a transaction to be completed.
2.5 The following cases in particular, but not exclusively, entitle us either not to credit the Points and/ or Rewards to you in full or in part, or to cancel/rescind them retrospectively in the event that they have already been credited:
Technical difficulties, irrespective of in whose sphere they occur
Merchant may not be able to complete the transaction, regardless of the cause
The return or cancellation of a purchased item or service, along with a refund (if any is due)
A purchase has been cancelled (annulment, rescission, withdrawal, etc.) or a chargeback has occurred
If there is a suspicion of fraudulent activity or abuse conducted by you
In case the Merchant lacks the resources (including employees during high-traffic times) to record your purchase along with the corresponding Loyalty Points.
3. Points Balance and Rewards status
3.1 You can view your current point balance and Reward status at the Merchant’s location on the consumer-facing screen by entering the phone number and/or email address you used to enrol in the Loyalty Program.
3.2 Any objections to the accuracy or completeness of the Loyalty Points balance and/or Rewards status must be submitted to the Merchant immediately, without undue delay, and in any event within one week of receipt of the Loyalty Points and/or Rewards. The Merchant is then obligated to escalate any discrepancies it cannot resolve with you to SumUp. Please include the relevant receipts or invoices with your objection. Failure to make a timely objection will constitute your acceptance of the Loyalty Points balance and/or Rewards status.
4. Redemption of Points and/or Rewards
4.1 Points can be redeemed to make a purchase at an eligible Merchant’s location, in accordance with its Loyalty Program/Rewards schedule. Redemption options and methods may change from time to time at our sole discretion. Please note that you can only redeem Loyalty Points at that Merchant’s participating location(s).
4.2 If a purchase is paid partially with Loyalty Points and partially without (such as with cash or credit card), you will only receive Loyalty Points for the amount not paid for by the redeemed Loyalty Points, not for the value of the entire purchase, unless otherwise stated.
4.3 The number of Loyalty Points required to be redeemed for Rewards may vary and will be determined at our sole discretion.
4.4 Other Prohibitions: You are only eligible to sign-up with one mobile number and associated email address. Loyalty Points are non-transferable. All redemptions are final and are not subject to cancellation initiated by you. The Points and/ or Rewards can not be paid out and have no cash value.
5. Expiration of the Rewards/ Loyalty Points and Termination of participation in the Loyalty Program and changes to the Terms and Conditions
5.1 We reserve the right to discontinue and/or terminate the Loyalty Program at any time, in our sole discretion and without reason. If the Loyalty Program is discontinued and/or terminated, your Loyalty Points will automatically expire. Expired Loyalty Points can no longer be redeemed.
5.2 You may terminate your participation in the Loyalty Program at any time without notice by simply not participating anymore. You also may communicate to opt-out from SMS and any email campaigns by the instructions provided to you by SMS or email, respectively.
5.3 We reserve the right to change the terms, regulations or benefits of participation of the Loyalty Program, in whole or in part, at any time with or without notice, even though changes may affect the number and/or value of the Loyalty Points you have already collected or the availability or value of redemption options. We furthermore reserve the right to terminate this relationship upon immediate notice and cancel any or all collected Loyalty Points and/or Rewards.
5.4 If the Loyalty Program is discontinued, the Merchant will inform you verbally the next time you visit the Merchant's location and upon request.
6. Miscellaneous
6.1 SumUp has no obligation to prevent and bears no liability for any service failure, fraud or loss associated with the Rewards program. SumUp makes no warranties, express or implied, with respect to the Loyalty Program and disclaims any warranty to the fullest extent possible. Both Merchant and you release SumUp (and its affiliates, officers, directors, employees and agents) from any and all claims connected with any disputes related to the purchases and/or redemption of the goods and services offered or redeemed through the Loyalty Program, or any non-compliance with any applicable regulatory requirements.
6.2 You and Merchant, respectively, are solely responsible for any tax liability related to participation in the Loyalty Program.
6.4 The Program is void where prohibited or if transactions are fraudulent, abusive, not completed through legitimate channels, in violation of any applicable Terms and Conditions, or irregular in any way, as determined by the Merchant and or SumUp.
6.5 By joining the Loyalty Program, SumUp may send you promotional offers, suggestions, discounts and marketing messages. SumUp collects, uses, discloses, retains or otherwise processes your information when you sign up for the Loyalty Program in compliance with SumUp’s Privacy Policy.
